Do you always have to go through probate in Texas?
Not always. Assets with a named beneficiary, such as life insurance and retirement accounts, payable-on-death bank accounts, and property held in a living trust or with rights of survivorship, can pass to your loved ones outside of probate. Whether probate is needed depends on how each asset is titled.
Is there a faster, cheaper way to settle an estate in Texas?
Texas offers one of the most efficient probate processes in the country. When the will allows it, or all the heirs agree, the executor can settle the estate with very little court supervision, which usually means less time, less cost, and less stress for the family.
Can I transfer a house or land from a will without full probate?
It’s a Texas shortcut. If there is a valid will, no unpaid debts other than a mortgage, and no need for a full administration, the court can admit the will as a muniment of title to transfer property, without ever appointing an executor.
How long do I have to file probate after someone dies in Texas?
Generally, a will should be admitted to probate within four years of the person’s passing. Waiting longer can force the estate to be divided under state intestacy rules instead of the will, so it is best not to delay.
What happens if a loved one dies without a will in Texas?
Texas intestacy law decides who inherits, and the rules are different for community property, separate property, and blended families. An heirship proceeding may be needed to establish who the legal heirs are.
Will my family owe estate or inheritance tax in Texas?
